Meeting of Legal Committee of the German-Russian Chamber of Commerce

Evgeniya Sinanova, partner of Solstico Legal, spoke at a meeting of the Legal Committee of the German-Russian Chamber of Commerce which brought together more than 60 participants online and offline. Evgeniya highlighted the topic "Risks of suppliers in connection with impossibility of fulfilling government contracts due to sanctions".
Evgeniya shared the consequences of imposing sanctions for suppliers involved in procurements under Federal Laws No. 44-FZ and 223-FZ, the prospects of writing off penalties and fines accrued by customers for non-fulfillment or delay in the execution of state contracts, as well as recommendations to reducing the risks for suppliers to be included in the so-called "Register of bad-faith suppliers" in the context of sanctions restrictions.
In a lively discussion at the end of the presentation the meeting participants discussed the prospects for qualifying sanctions as force majeure in public procurement disputes, as well as the possibility to use arguments based on special public procurement legislation in other categories of disputes.
